1. Acceptance of Terms

By accessing and using the services provided by Fourth Dimension Modern Foundry ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all customers, including individuals, businesses, and organizations that engage our 3D printing and additive manufacturing services.

2. Services Description

Fourth Dimension Modern Foundry provides professional 3D printing and additive manufacturing services, including:

  • Rapid prototyping services
  • Small to medium batch production
  • Custom manufacturing solutions
  • Design consultation and optimization
  • Material selection guidance
  • Post-processing and finishing services

All services are subject to our capabilities, material availability, and production capacity at the time of order.

3. Order Process and Acceptance

3.1 Quote Requests: All projects begin with a quote request through our website or direct communication. Quote requests are not binding commitments.

3.2 Quote Validity: Quotes are valid for 30 days from the date of issue unless otherwise specified.

3.3 Order Acceptance: Orders are accepted only upon our written confirmation and receipt of required payment or deposit.

3.4 File Requirements: Customers must provide print-ready files in acceptable formats (STL, OBJ, 3MF, etc.). We reserve the right to request file modifications for optimal printing results.

4. Payment Terms

4.1 Payment Schedule:

  • Orders under $500: Full payment required before production begins
  • Orders $500-$2,000: 50% deposit required, balance due before delivery
  • Orders over $2,000: Custom payment terms to be agreed upon

4.2 Payment Methods: We accept cash, check, credit cards, and electronic transfers.

4.3 Late Payments: Overdue accounts may be subject to a 1.5% monthly service charge and suspension of services.

4.4 Price Changes: Prices are subject to change due to material cost fluctuations or design modifications.

5. Intellectual Property

5.1 Customer IP: Customers retain all intellectual property rights to their designs, concepts, and files submitted for printing.

5.2 Confidentiality: We treat all customer designs and information as confidential and will not disclose or use them for any purpose other than fulfilling the agreed services.

5.3 Company IP: Any custom tooling, processes, or technical solutions developed specifically for a project may involve separate intellectual property considerations to be discussed on a case-by-case basis.

5.4 Prohibited Content: Customers may not submit designs that infringe on third-party intellectual property rights or violate applicable laws.

6. Quality and Delivery

6.1 Quality Standards: We maintain high quality standards as outlined in our Quality Standards page. All parts are inspected before delivery.

6.2 Delivery Times: Delivery estimates are provided in good faith but are not guaranteed. Delays may occur due to material availability, equipment issues, or design complexity.

6.3 Inspection Period: Customers have 7 days from delivery to inspect parts and report any quality issues.

6.4 Reprints: We will reprint parts at no charge if quality issues are due to our error and reported within the inspection period.

7. Limitation of Liability

7.1 Service Limitations: Our liability is limited to the cost of the specific services provided. We are not liable for consequential, indirect, or incidental damages.

7.2 Material Properties: While we provide guidance on material selection, customers are responsible for determining suitability for their specific application.

7.3 Design Responsibility: Customers are responsible for the structural integrity and functionality of their designs. We provide manufacturing services, not engineering validation.

7.4 Maximum Liability: Our total liability for any claim shall not exceed the amount paid for the specific services in question.

8. Cancellation and Refunds

8.1 Customer Cancellation: Orders may be cancelled before production begins with full refund minus any design or setup fees incurred.

8.2 Production Cancellation: Once production has begun, cancellation may result in charges for materials used and work completed.

8.3 Company Cancellation: We reserve the right to cancel orders that violate these terms or are technically unfeasible.

9. General Provisions

9.1 Governing Law: These Terms are governed by the laws of the State of Florida.

9.2 Dispute Resolution: Disputes will be resolved through binding arbitration in Orange Park, Florida.

9.3 Modifications: We reserve the right to modify these Terms with 30 days notice to customers.

9.4 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

9.5 Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
